When buying a property in Malta, it is customary to sign a preliminary agreement, known as Promise of Sale (POS), in which the seller and the buyer commit to signing a final deed of acquisition subject to a number of conditions listed in the agreement being met within an agreed timeframe. The most common conditions include the acceptance by a local bank of the buyer’s mortgage application, and a positive outcome in the notarial and legal searches on the title of the property. After signing the (POS), your bank and notary will require a series of documents signed by an architect for the successful processing of their respective tasks. The documents include a Land Registry site plan mapping the property, a completed valuation form and valuation report for the bank, a declaration for the Inland Revenue Department.
